General terms and conditions Finca Gordo bed & breakfast

We warmly welcome you to our B&B and ask you to familiarize yourself with our general terms and conditions and privacy statement.

  1. GENERAL 1.1 These Terms and Conditions apply to all guests of Finca Gordo Bed & Breakfast. 1.2 By submitting a reservation request or booking, you, as a guest of Finca Gordo Bed & Breakfast, agree to the Terms and Conditions. 1.3 The minimum stay at Finca Gordo Bed & Breakfast is two nights. 1.4 Check-in is from 4:00 PM to 8:00 PM, and check-out is from 8:00 AM to 11:00 AM. Exceptions can be made upon request. Late check-in is possible, but after 11:30 PM there is a charge of €20.00. Late check-out is possible if the room is not reserved on the day of departure. The price is €20.00. No refunds will be made for early departure. 1.5 Smoking is not permitted indoors or in the rooms. Smoking is permitted outdoors. However, due to fire hazard and hygiene, please dispose of all smoking waste in ashtrays and extinguish it thoroughly before you lose sight of it. 1.6 Pets are not allowed. 1.7 Finca Gordo Bed & Breakfast is an adults-only accommodation, so the minimum age is 18 years. An exception applies if you rent the entire accommodation. (See more on the website under "Questions"). 1.8 Guests can park their car in a private parking lot. Parking is always at your own risk. 1.9 Guests must have a permanent residence. 1.10 The owners of Finca Gordo Bed & Breakfast may immediately deny and/or refuse guests access to the accommodation in the event of violation of the general terms and conditions and/or house rules, or in the event of inappropriate behavior, without further notice or explanation, and without refund of accommodation costs. 1.11 Finca Gordo Bed & Breakfast reserves the right to change the terms and conditions. You accept and acknowledge as binding the terms and conditions in effect at the time you use the Finca Gordo Bed & Breakfast website and facilities.

  2. RATES 2.1 The rates shown are per room, per night, and include breakfast for two people. Rates booked through a booking site often exclude breakfast. 2.2 The rates shown include water, electricity, air conditioning, and bed and bath linens. We would appreciate it if you would avoid unnecessary use of water and air conditioning. 2.3 The rates shown include VAT (or a similar tax) at the applicable rate. 2.4 The rates shown exclude use of the honesty bar and other services offered by Finca Gordo Bed & Breakfast. 2.5 The rates shown exclude cancellation and travel insurance. We recommend that you take out cancellation and travel insurance. 2.6 The rates shown are subject to change.

  3. RESERVATION AND CONFIRMATION 3.1 A reservation request or booking can be made verbally, by phone, in writing, by email, or through booking sites. 3.3 After receiving your reservation request and the confirmation sent by Finca Gordo Bed & Breakfast, you are obligated to pay the deposit. The reservation is only final once you have received confirmation from us and the deposit has been paid.

  4. PAYMENT 4.1 The deposit is 50% (for booking sites other than our own, different % may apply); once the deposit has been received, the reservation is final. The remaining payment must be paid no later than 4 weeks before arrival. 4.2 If you book within 4 weeks of arrival, the total amount of the stay must be paid immediately. 4.3 The deposit and remaining payment must be transferred to IBAN: ES7700817430440001434245 BIC: BSA-BESBB Or Dutch bank account NL37 ABNA 0981 8322 45 BIC ABNANL2A in the name of PWAMC Laarakker, El Porton 13, Riogordo (Málaga), stating Finca Gordo and your reservation number. 4.4 Any remaining costs for use of the honesty bar, etc. must be paid before departure, preferably in cash, by debit card or credit card. Prices can be found at the honesty bar. 4.5 For payments by debit or credit card, we charge a 3% surcharge on the total amount for bank charges.

  5. CANCELLATION 5.1 Cancellations will only be accepted in writing or by e-mail, quoting your booking number. 5.2 If the booking agreement is cancelled, the following cancellation costs will be charged: In addition to the booking and other costs owed, the following applies: • In case of cancellation up to the 90th day before arrival: 15% of the rental price; • In case of cancellation from the 90th day up to the 60th day before arrival: 50% of the rental price; • In case of cancellation from the 60th day up to the 31st day before arrival: 75% of the rental price; • In case of cancellation from the 31st day up to 1 day before arrival: 90% of the rental price; • In case of cancellation on the day of arrival or later: 100% of the rental price. 5.3 In case of a no show, the full amount of the stay is due. 5.4 We advise you to take out adequate travel cancellation insurance.

  6. FORCE MAJEURE 6.1 In the event of force majeure, whether permanent or temporary, Finca Gordo Bed & Breakfast is entitled to terminate or temporarily suspend the agreement in whole or in part, without the guest being entitled to claim performance and/or compensation. Force majeure includes, but is not limited to: threat of war, war, uprising, strikes, boycotts, disruptions to the energy supply, traffic, or transport, government measures, scarcity of raw materials, natural disasters, and furthermore all circumstances, extraordinary weather conditions, death of one of the owners or immediate family members, etc., under which full or partial performance of the agreement cannot reasonably be expected of the accommodation. Naturally, we will do everything we can to provide you with alternative accommodation in that event. If you do not wish to make use of this option, the costs paid will be credited to you.

  7. LIABILITY 7.1 Finca Gordo Bed & Breakfast cannot be held liable for any damage suffered by the guest or third parties as a result of their stay at the accommodation; the guest indemnifies Finca Gordo Bed & Breakfast against any claims in this regard. Finca Gordo Bed & Breakfast is not liable for disruptions in and around the accommodation, such as disruptions and outages of power and water supplies and technical installations, or unannounced or untimely construction and/or roadworks near the accommodation. Finca Gordo Bed & Breakfast is not liable for damage, loss, or theft of the guest's personal belongings. 7.2 Finca Gordo Bed & Breakfast can only be held liable for damage attributable to gross negligence or neglect of the owners. 7.3 The accommodation's liability is furthermore always limited to the maximum amount that Finca Gordo Bed & Breakfast's insurer will pay in the relevant case. 7.4 Use of the swimming pool is at your own risk. Finca Gordo Bed & Breakfast cannot be held liable for bodily injury or damage to personal property resulting from the use of this property.

  8. DAMAGE 8.1 The guest must behave appropriately and use the bed and breakfast accommodation in accordance with reasonable usage instructions provided by the accommodation or the owners. 8.2 The main guest is legally liable for any damage caused by them or their fellow guests to Finca Gordo bed and breakfast or to any property or persons present therein. 8.3 The guest must immediately report any damage to the owners. Repair and/or replacement costs must be reimbursed by the guest. 8.4 In the event of loss of keys, all resulting costs will be charged to the guest.
